Wyoming Ignition Interlock Laws
Wyoming legislative bodies have enacted strict DUI laws in order to help curtail the spreading problem of drunk driving on its highways. More than 6,000 people were arrested for DUIs in 2008, a number that law enforcement officials hope to reduce in the near future through increased vigilance in the enforcement of DUI laws and new stricter penalties that include things like the installation of Ignition Interlock Devices.
Ignition Interlock Laws in Wyoming are fairly straightforward. Generally speaking, they are required after a DUI offender has been arrested for a 2nd drunk driving event. In some cases, however, a Wyoming DUI judge may require an IID be installed sooner. If a driver, for instance, has a BAC over .15, they may be required to use an Ignition Interlock Device for a period of six months from the date of conviction. The other IID requirements are as follows:
For 2nd DUI convictions: driver can only operate vehicles equipped with IIDs for a period of one year from the date of conviction.
For a 3rd DUI conviction: driver can only operate vehicles equipped with IIDs for a period of two years from the date of conviction.
For a fourth or subsequent DUI conviction: driver can only operate vehicles equipped with IID for the remainder of the offender’s life. Every 5 years from the date of conviction (and every 5 years after) the offender may apply to the court for removal of the IID.
IID requirements can also be required for driver’s who are pulled over but do not obey Wyoming’s implied consent law. This law dictates that driver’s must submit to chemical tests following a DUI traffic stop. 1st time refusal will result in suspension of Wyoming driving privileges for six months and a 2nd or subsequent refusal can result in an 18 months suspension and requirement to install an IID on their auto.
When Wyoming DWI offenders install an ignition interlock device on his or her vehicle, they are able to retain their legal driving status as a provisional driver. This enables them to maintain employment, attend school, complete substance abuse treatment and take care of their responsibilities while adhering to the requirements of the Wyoming DUI courts. This is particularly important in rural areas where offenders may not have access to public transportation alternatives.
In an effort to reduce the instances of recidivism among DUI offenders, legislative bodies across the country are instituting stringent drunk driving laws that have requirements like mandatory Ignition Interlock Device installations. By separating the acts of drinking and driving, law enforcement can help protect innocent drivers by insuring that the worst of Dui offenders, the ones who repeat their behavior, stay off the roads.
