Wisconsin Ignition Interlock Laws
Have you been arrested for a DUI in Wisconsin? You are not alone, more than 40,000 people were arrested for DUI’s in Wisconsin in 2008. One of the higher amounts in the country. In an effort to protect the commuting citizens of the state, law enforcement and legislative bodies have enacted stricter DUI laws which include the use of Ignition Interlock Devices to help prevent drunk driving.
An ignition interlock device is a breath-alcohol testing device, about the size of a cellular telephone that is installed on the steering column of a car. The ignition interlock system will prevent the car from being started unless the driver blows into the ignition interlock device to demonstrate that he or she is below a pre-determined BAC (breath alcohol concentration).
IID’s are extremely effective at prevent recidivism among DUI offenders. Individuals who are arrested for drunk driving in the state (and across the country) are more apt than any other criminal to repeat their crime. The worst DUI offenders are more often than not alcoholics who have problems controlling their addictions. It is only a matter of time before they get behind the wheel of a car inebriated. The IID prevents them from starting the automobiles that they drive.
Wisconsin IID Laws do not kick in until an individual has been convicted of their 2nd DUI offense. For a second or subsequent offense, a person must have an IID installed for 1-year more than maximum period of license revocation. 2nd time DUI offenders will have their license revoked for up to 10 years, while 3rd time offenders may have their license suspended indefinitely.
One exception to the 2nd offense rule is if the 1st DUI offense had a driver who had a BAC of .15 or higher. This is considered an abnormally high (and dangerous) BAC and the court can mandate the use of an IID at its discretion.
