Missouri Ignition Interlock Laws
Have you been arrested for a DWI offense in Missouri? You are not alone, over 31,000 people were arrested for DWI in Missouri in 2008. Meanwhile, more than 300 individuals died on the highways of Missouri due to alcohol related accidents. In an effort to curtail these numbers and help get a handle on the rash of DWIs in the state, Missouri has enacted specific Ignition Interlock statutes.
An Ignition Interlock Device is an alcohol breath testing unit that is installed in the steering column of a car. The device requires an individual to provide a sober breath sample before a car’s ignition will be turned on. Any test result over .03 will not start the ignition. The IID is installed in the vehicle at the order of the courts and will remain there the entire length of the restricted licenses life. Any person who wishes to operate the vehicle must use the device in order to start it. Fail safe’s include the need for random breath samples while the car is in motion to prevent a sober friend from starting the vehicle. Failure to provide a sample or a sample over the requisite BAC level (.05) will result in the sounding of alarms.
When a license is suspended or revoked an ignition interlock is required to be maintained on any and all motor vehicles by the DWI offender for a period of not less than six months immediately following the date of reinstatement.
A court may require that any person who is found guilty of or pleads guilty to a first intoxication-related traffic offense shall not operate a motor vehicle unless it is equipped with a functioning, certified Ignition Interlock Device. It is important to note that first time DUI offenders are not REQUIRED to have Ignition Interlock Devices installed on their cars. The discretion is left to the judge in the case as to whether IIDs are necessary, which allows the circumstances of the case to determine the severity of the punishment.
2nd and subsequent DWI offenses shall require that any motor vehicle that the driver operates must include an ignition interlock device. The device must remain on the car for six months after the reinstatement of the offenders full driving privileges.
