Indiana Ignition Interlock Laws
Have you been arrested in Indiana on drunk driving charges? Depending on the circumstances surrounding your OWI arrest, you may be required to have an Ignition Interlock Device installed onto your car in order to get your driving privileges back. Indiana, like other states in the US, have taken the threat of OWI offenses very seriously. With hundreds of OWI fatalities each year, and better than 20,000 OWI arrests by Indiana law enforcement officials, it is safe to say that Indiana is not exempt from the influx of DWI instances on our highways.
In response to this threat, legislatures all over the country (including Indiana) have made OWI laws and punishments much more stringent then they once were. By making the penalties for OWI exceedingly harsh and requiring things like Blood Alcohol Ignition Interlock Devices (BAIID), the powers that be hope to limit the risk for the good citizens of the state who take to Indiana highways on a daily basis.
One of the immediate effects of an Indiana OWI offense is the 90 day suspension of the individuals driver’s license. 2nd or 3rd time offenders can have their license suspended for up to two years (at the discretion of the OWI courts). In these instances, a driver can obtain probationary driving privileges, so that they may attend work, school, or other necessary functions where car travel is a necessity. As a condition for obtaining probationary driving privileges, the court may require a defendant to use only vehicles equipped with ignition interlock devices for a term established by the court with the limitation that such term cannot exceed the maximum prison sentence; violation of this requirement is a Class A infraction.
Other provisions of law enforcement is that a person convicted of an OWI offense (within 5 years of a previous conviction) may be granted probationary (restricted) driving privileges on the condition that the person only operate vehicles equipped with ignition interlock devices. Typically, decisions like these are left to the opinion of the judge. By considering all factors involved in each specific case, the judge is best able to determine if the DUI offender is at risk for repeating their behavior, or if they should be admitted for medical treatment for a substance abuse problem.
