Illinois Ignition Interlock Laws
Illinois is no stranger to the issue of DUI related offenses and alcohol related accidents and fatalities on their highways. In 2008, more than 400 people were killed in alcohol related motor vehicle accidents, while Illinois law enforcement arrested over 5,500 people for DWI related offenses. In response to these numbers and the growing problem of DWIs in the state of Illinois, the legislature has enacted laws that require drivers who are arrested for DWI to install Ignition interlock devices on their automobiles in order to regain the right to drive. The period during which the IID is required depends largely on the amount of time the driver’s license is suspended.
Illinois recently enacted a law requiring certain DUI offenders to install a Breath Alcohol Ignition Interlock Device (BAIID) into their cars upon a conviction for DUI. In addition, persons who had their driver’s license suspended as a result of a chemical test refusal or “failure” (by providing a sample of .08 or higher) may be eligible for a Monitored Device Driving Permit (MDDP) that allows the person to drive so long as a BAIID is installed on their vehicle.
Illinois is one of only six states that require first time DUI offenders to have Ignition Interlock Devices installed on their vehicles. IID’s have significantly decreased the number of subsequent DUI offenses among those who would typically become repeat offenders, and it helps to ensure that a much lower number of drivers attempt to operate a vehicle after drinking. Research has shown a 50- to 90-percent reduction in subsequent DWI recidivism when offenders have installed ignition interlocks on their vehicles.

By preventing impaired drivers from starting and operating motor vehicles, the separation of an unsafe driver from a vehicle that has the potential to be a deadly weapon may prevent untold tragedy. Ignition Interlock devices have documented success in limiting alcohol impaired driving, especially among those drivers who have been arrested for DUI in the past. Perhaps even more importantly, IID installation allows drivers to regain their driving privileges much faster then they would have otherwise, allowing them to function as valued members of our society. By allowing DUI offenders who have gone through the legal process an opportunity to drive themselves to work, to school, and to manage their lives while driving to and from court approved locations, individuals can gain some semblance of normalcy and control over their circumstances, an important aspect of rehabilitation.
